Conditions not displaying Privacy is displaying

I have a conditions.php in the includes/languages/english/ folder that appears not to be being picked up, when i try to load the page ( via url www.pictu.co.uk/catalog/ ) i only get HEADING_TITLE and TEXT_INFORMATION displayed as literals. I have checked the filenames.php and it references

define('FILENAME_CONDITIONS', 'conditions.php');

 

The Privacy page works for some unknown reason

check that this line is present in your catalog/conditions.php near the top of the file

require(DIR_WS_LANGUAGES . $language . '/' . FILENAME_CONDITIONS);
