Using osc function/class files

Hello,

 

I'm building a website based on the general oscommerce directory structure and a few class (and function) files from oscommerce. I have stripped off most parts including the shopping cart, the entire database and the admin section completely. I have a couple of questions about the way I use oscommerce...

 

1. Is it permissible to use class/function files from the oscommerce distribution? By the way, I have left the credits and the GPL license information intact in all the files.

 

2. Should my site display the "Powered by osCommerce" link? I really don't mind displaying it, but my only concern is that it might mislead people into believing that the site is powered by oscommerce, when it might actually not be.
