This is all branded stuff procured from Asia legitmately and paid customs and VAT. I want to know do I need permission from these brands or can they stop me from selling these . Please help Pranav
MrPhil Posted February 14, 2014 Posted February 14, 2014 Well, if your goods are counterfeit or knock-offs, you'll certainly be in legal trouble (trademarks, possibly copyrights and design patents). Even if they're legitimately carrying a well-known brand name, brands will often try to stop you. Whether you have a chance of prevailing against them depends on your country and its laws and attitudes towards intellectual property. Brands do have a legitimate concern about gray market and out-of-channel sales of their goods damaging their image. They put a lot of effort into controlling what consumers see in advertising and in their purchasing experience, and have very close ties to big retailers to ensure this, so don't be surprised if they come after you, even if they don't really have a legal leg to stand on. I have heard of them filing charges that you are violating trademark laws or carrying counterfeit goods, without even doing a thorough investigation first.
♥joli1811 Posted February 14, 2014 Posted February 14, 2014 Hi Pranav Had a similar problem few years back with a client although the brands were original they were not licensed for sale outside of Asia so what will eventually happen is your host will be asked to close the website or your payment provider will be asked to close your account.or worse you will get a Lawyers letter There are many legal firms out there who's job is to score the web for such items so not worth the hassle sooner or later you will have trouble. One example being Lacoste T-shirts factory in Thailand and reach the streets for maybe £4 right down to the pearly buttons simply not licensed for export. You need to take permission from those famous brand to sell their products ultimately. So, stop if you are doing this continuously because this can be cause trouble for you.
