Personally, I think it's wrong to do this.. I don't see a credit to OSC anywhere in this add.

 

I host OSC sites for my clients, but they know I did not develop this software, nor do I try to indicate anything of the like. The admin panel displays all the OSC links and logos as well as Copywrite info..

 

Anyhow.. nuff of that... Just thought I'd put this out so Harald could smack im ! =)

They are charging for installation. I do the same thing though my prices are a little lower.

 

Also under GPL, you can charge someone a few to handle costs associated with putting the softare on a disc and sending it to them. Nothing wrong there either.

Why would they need to credit Oscommerce, that is not part of the license. The only "credits" needed are those within the Admin Section Footer, as well as those within the PHP files themselves.

 

What they are doing is entirely legal under the terms of the present license. Under the terms of GPL, you can actually charge for anything and everything except for the base Oscommerce scripts...and that charge can be as much or as little as you wish.

All that's between you and a powerful profitable website is getting the store software installed but now we eliminate that expense because we install it for you at no extra charge.

 

So they are selling something. Further reading shows that it seems to be that they are selling a hosting package with osCommerce included. An educated guess would be that they are using some cpanle based hosting package that includes osComerce and some other GPLed scripts.

And ofcourse they have to leave the copyright notice intact for the catalog if no design changes take place. The layout of osCommerce is copyrighted by Harald Ponce de Leon. This has nothing to do with the license. If someone claims the copyright over the layout and artwork of a stock osCommerce it is a copyright infringement. This has been discussed and explained numerous times before. Take a look at this forum. Notice the footer:

This is exactly the same thing. If we change the theme of phpBB we can also claim the copyright over our theme. But as long as we use this theme we are not allowed to change the copyright.

Yes, the look is copyrighted to Harald/Osc. If the look is changed there is no need to have any link or copyright to Harald/Osc...other than as mentioned in the code and the Admin footer...(see my questin below though)...

 

Question: If the stylesheet is changed substantially, and the original buttons are still being used, does the catalog/includes/footer.php copyright noticve have to remain intact? Many sites still use the same buttons...

 

2nd Q: What constitutes enough of a change to warrant the removal of the Osc copyright notice (in the shop) ?

I didn't even get paid for that installation. I sure as HELL didn't say it could be featured. It ain't my site, but boy oh boy, I no happy.

well i have a good idea where they are hosting the packages....

 

they are taking credit for a shop i designed, not to mention, www.madpuppyinc.com had a part in since i code for that site. furthermore, he took off the madpuppyinc banner off the real site, making it appear as if they were the ones to design it.

 

i wanna see one of them design the site. so that's why i've been getting, "could you design a site for me" messages.

 

 

grrr!

 

there's nothing wrong with offering a package, but something about this topic seems dishonest somehow. the best part is i designed that top page for no charge at first, hahaha, i got screwed. cuz he even took off the mpi banner.

what they are selling is information... specifically information on how to "Build and Sell Online Stores On Ebay"... what they include is a website and a CD with the information on it... nothing illegal about that... in fact that has become the new FAD on eBay, to sell "information"

no, it's dishoest.

 

they are showing examples of what a web page could look like. if they are not the ones to create these websites, or design them, then the pictures are misleading.

 

not everyone can scirpt, and a lot of design requires scripting. there is no guarantee that their 'information' can provide that.

 

so therefore, they are using a very invalid example. they act as if just anyone off the gravy train can do it. fine, in theory, yes, but when it comes to following code, i doubt some newbie is really going to be able to go into osc within a few days and change it around.

 

therefore, i find their topic misleading....

 

why not use examples THEY'VE done?
