I have had some more private messages concerning these posts. Seems some worst fears have been confirmed. Apparently an osCommerce user got sued. I don't think this means osComemrce is dead. Europe can still devlop it! It just means that American developers are at risk... including me. All I can say is ?sue me? : )

 

I don't program, I market and design for open source software to a lot of very poor businesses that can't afford much... let alone a patent license. The businesses I develop for are least likely to be sued as they are barely able to keep their doors open. If PANIP forces them to shut down it could get very interesting as I live in a town infested with ant-corporate activists who have made an impact at least in my local community and other states.

 

As American ecommerce developers maybe we should focus on small poor feisty businesses until this blows over? If it weren?t for me 2 businesses I work for (cheaply) would have folded a year ago. As a designer and a political/corporate activist who is very poor myself I don't fear PANIP as I have no money for them to take. If they force the issue I guess I could defect to Canada :P

 

I have seen small groups of American citizens rally against large corporations and win. It just takes a little initiative and guts. About 20 of activists got together with some independent media (which attracted mainstream media), raised public awareness and stopped a Wal Mart Super Center from being developed near a quiet community neighborhood. This was after Wal Mart threatened to sue the community and the city once we started making noise! We laughed because we had nothing to lose? guess won? We did : )

 

The fight is just beginning... as soon as PANIP begins to stop more new businesses from venturing on the Internet and becomes a detriment to our already shaky economy we may not see a change. If enough "poorer" businesses rally together and gain some support from enough "big" businesses we could see some changes soon.

 

It's going to take a lot of pissed off developers and business to put a stop to this and it will probably take more small businesses being sued to fuel the fire... a lot more unfortunately because people usually don't respond until things get out of hand.

 

Seems people don't react until a situation reaches critical mass. I say we are no where close yet... Anyone want to form an action committee?

sometimes, im embarrased to be an american. There are lots of fat lazy people out to make a quick dollar, and are intent on using their energy to screw other people rather than create something on their own. Dante has a nice level for them.

I'm proud to an American who is willing to risk and lose everything to fight for what he believes in.... and I have several times. Having no family helps of course. One time I actually gained something :P

 

There is power in numbers. No man or woman is an island :wink:

 

Maybe we can sue PANIP once they have enough money to make it worth while for the right lawyers ?

yes, it is good to put your energy into productive endeavors. I enjoy contributing to these forums and helping improve this wonderful product. if someone tries to sue OSC i will help fight them every way i can

If we (whoever "we" are) sues PANIP then there is no real justice unless it is a countersuit (and "we" are the initial defendants).

 

Convincing the Attorney General to charge them with extortion however... :P

 

I'm curious if the EFF (or any such group) is willing to assist in taking a stance against these people.

It might help if you and everyone who reads these posts simply spreads the word... send a well written email or 2 to eBay, Amazon, PayPal, ect. asking questions like "am I in danger of getting sued for using your services?".

 

I'm sure there's a subtle way of putting things to spread general panic among established eBay sellers and people using similar services too. Language can be an interesting tool... the pen is mightier than the sword :wink:

 

I believe we need to make some noise to large ecomemrce businesses and point out how PANIP and Divine may "indirectly" cause them financial harm.

 

These forums are a great start but we are preaching to the choir here. We need to work outside of the box to be effective.

I can only ask yous to take a look at www.youmaybenext.com and contact the EFF and/or FSF in this case. Maybe also talk with journalists if you know some.

I agree. We need to put this thread to rest here until someone else here takes a hit. Then I think it might be appropriate to alert the community to encourage another round of mailings and see if anyone with legal or media connections can help us.

 

PANIP's website is also back online if anyone wishes to see what we're actually dealing with here: http://www.panip.com

 

I have downloaded their web site for offline viewing should they remove it for any reason in the future :wink:

 

Remeber: laws can be changed and patents revoked :!:

Are you sure panip.com is the company that is suing ?

Their site looks like it's made in 50's by a kid...holy crap.

 

It's ridiculous...I should patent my ass so I can sue anyone who has ass that looks like my ass :twisted:

 

Anyway...Good will win out in the end so I am sure we will win.
