Mmmh my 'espanol' sucks but I can see he's changed the copyrights on the header & footer without changing ANYTHING... that's violating Harald's copyright AND the GPL.

There is no problem with a commercial enterprise using OsCommerce so long as the terms of the GPL license are not broken.

Maybe these people (and others making a $$$) are sticking to the license - have you asked them?

I am aware of that but this is quite different. Although it is presented as being Open Source released under the GPL licence the software itself is presented as if it was written by these guys and not the osC team.

That is wrong, not the fact they are making money with it....

I cant find the osCommerce link or reference anywhere on their site.

When i first saw that site i thought there was some osCommerce package thing being done somewhere else but didnt see no credits to the original team no where so i figured let me post it and see.

The developers that design software to be shared, to be improved and distributed freely, can use the registered tradename Open Source if their terms of distribution adjust to the OpenSource definition of the OSI. Basically, the distribution model requires that:

Free distribution: There are restrictions no to sell or to distribute software.

Source code: Software must include the source code and must allow to create compiled distributions as long as the form to obtain the source code is exposed clearly.

Derived works: One is due to allow to create derived works, that they must such be distributed under terms that the original license of software.

Integrity of the source code of the author: Is due to allow the distribution of the modified source code, although they can have restrictions so that the original source code of the source code of the derived work can be distinguished.

Distribution of the license: The rights that accompany the program must be applied with no need to all the one that redistributes the program, of additional licenses.

The license does not have to be specific to a product: The rights that the license gives do not have to be different for the original distribution and for which it works in a totally different context.

The license does not have to go against another software: The license does not have to restrict another software that is distributed with the same one. For example, the license does not have to indicate that all the programs distributed jointly with must be opensource

trabajo

derivado.

No discriminar personas o grupos: La licencia no debe discriminar a

ninguna persona o grupo.

conjuntamente

con el deben ser opensource
