shopping cart dupllicates on delete

Just about to go live and found this error,

 

when 2 items are placed in shopping cart and you want to remove the TOP listed one, it doesn't remove and the bottom one duplicates itself into the space, you can then delete that one?

 

if you choose to delete the BOTTOM listed item that works fine.

 

furthermore, if you have say 3 items in the cart and try to delete the TOP listed one, the 2 underneath duplicate themselves etc etc.

 

i'm baffled, it must be something really simple?
