Checkboxes before selling

I've used Oscommerce a few times before but I have recently come across a problem where a customer wants a checkbox adding to oscommerce that users/customers must tick/flag before being able to go ahead with a purchase.

 

The site concerned is used for selling fuels, one of which is gas bottles for a small business. He wants clients to be able to buy bottles of gas online, but wants to have some way of making the customer state that their current gas bottle is empty. This is becuase it costs to empty gas bottles before re-filling them.

 

I will list 2 different types of gas bottles, one which is brand new where the customer doesn't already have a gas bottle, and another that allows refills of gas bottles. That bit is easy, but how can I make a customer tick an option when they wish to refill their gas bottle - that states their gas bottle is empty?

 

Any feedback/suggestions are much appreciated.
