He is accepting payments by paypal but wants to add a surcharge when that option is selected - 3% of order total in order to cover paypal's fees. I havn't been able to find any way of doing this, is it possible? Quote
Guest Posted January 24, 2006 Posted January 24, 2006 I may be wrong but I believe adding a surcharge is against PayPal Terms of Service. I recall seeing that some where ... Mastercard, Visa and others will cut off the account if someone is caughe charging more for using credit cards. This was part of huge lawsuits a few year back. For instance the Truckers sued the truckstops for charging more for credit sales and less for cash sales and I believe it is in the TOS of the credit card companies though no law to speak of. Be careful. I handle this by adding 3% into the cost and leaving it at that. If someone pays cash. it is a bonus. But be careful of the TOS and not lost PayPal for charging since I believe it is against their TOS. Quote

Acording to the TOS at PayPal https://www.paypal.com/us/cgi-bin/webscr?cm...policy_payments in the "Payments (Sending, Receiving, and Withdrawals) Policy" Section V: No Surcharges. Under Visa, MasterCard, Discover and American Express regulations and the laws of several states, including California, merchants may not charge a fee to the buyer for accepting credit card payments (often called a "surcharge"). You agree that you will not impose a surcharge or any other fee for accepting PayPal as payment. This restriction does not prevent you from imposing a handling fee in connection with the sale of goods or services, as long as the handling fee does not operate as a surcharge (in other words, the handling fee for transactions paid through PayPal may not be higher than the handling fee for transactions paid through other payment methods). I know of one client who's account was terminated for a violation of this section. Quote
