Are templates and their graphic files (when distributed as part of a complete osC build) automatically under GPL? Could such a build then be distributed free of charge, under GPL? Etc, etc. Jon.
Guest Posted August 5, 2004 Posted August 5, 2004 I would think the person who packages such things, would have to protect their design from being sold on again and again their own terms and conditions would have to be included in the package and you made aware of such a contract. But hey I am not an expert on this but just my opinion.

You would not be able to claim ownership of the theme of the site. You would also be subject to the sellers Terms and Conditions of Sale, which you agreed to at Point of Sale. UK Law is the factor here.

UK Law is the factor here. What constitutes GPL code in this situation? Is a completely new stylesheet covered as it is part of the distribution, or is it excluded as it is original? What if the terms and conditions are in conflict with GPL. For example, if the seller says you can't re-distribute? Sounds like provided you remove / change all the images, re-distribution would be ok? Jon.
Guest Posted August 6, 2004 Posted August 6, 2004 With regards to the images of the template as burt mentioned they would be copyright of the designer unless he has expressed they be included into the gpl licence and freely distributed.
